Case stated – in the practice this legal term has got application in the Court procedures. There it refers to an enquiry by the local court towards a higher court for issuing opinion on the Law, in relation to resolving an issue within a concrete pending lawsuit. The instructions and interpretation of the Law, issued by the higher court, will be binding the lower court about how the law should be applied, and how the court procedure should be performed by the lower court which hears the lawsuit.
