Defendant – The Civil Law stipulates the defendant to be the person, corporate body or organization who defends a legal action taken by a plaintiff and against whom the court has been asked to order damages or specific corrective action redress. In criminal cases this is the private individual against who a criminal proceeding has been brought by the prosecutor for hearing in court room and proclaiming innocent or guilty (with the related charge/punishment).
