Joint civil lawsuit – within the meaning given by the Civil Law in many legal systems, this is a court case entered by many claimants against the same defender. It is specific that the source of the claim is the same, as well the pretentions and the proofs presented by the claimants.

Especially in Bulgaria, many overseas investors believe or have been misled by competitors that in order to cut expenses they are legally entitled to enter a group claim or a group action against one developer for non-performance of preliminary contract; but this is not possible because their separate pretentions arise from different legal sources (i.e. their individually signed various preliminary contracts); the proofs are different (everybody has paid different amount of money via different way of payment and obtaining different proofs of payment) and the amount of their concrete pretentions (i.e. the money to be refunded) are different ones.
