Permissive occupancy

Permissive occupancy – this legal term is formed from the words “permissive” that literally means “tolerant, susceptive”, and “occupancy” that literally means “habituating” or “living in”. In Law, this term finds application in the area of Real Estate Law. There it describes a long-term occupancy of premises. This type of occupancy and enjoyment is not harmful for the interests of the Title holder. Depending of the local legislation, such permissive occupation could be authorized or allowed to the tenant on the base of rent/lease contract with embedded clauses for increasing its term, or via implied permission by the landowner. Because it is legal right, the permissive occupancy could be defended against all third parties.
