Rescissory damages – in practice this term applies in the Tort Law, where refers to fair monetary compensation awarded by the court towards the claimant on the base of the market value of the damaged assets or properties that have to be restored. The goal of the rescissory damages is to put the claimant in a position as before the wrongful act has been done (i.e. as if the tort never happened). The rescissory damages do not have a role of a sanction towards the wrongdoer, but only of a fair compensation.
