Resolutive clause

Resolutive clause – this term has got application in the Law of Contracts, where refers to a clause for annulment. In other words, it establishes in what situations the contract may be cancelled or revoked so the parties may be released from their obligations. Usually parties agree that such action may occur in events of continuous non-performance by one of the parties. The term is formed from the words “resolutive”, meaning obsolete, and “clause” that mean term or condition within a contract.

The term “resolutive clause” should be differed than the resolving clause, which is something else – namely a clause that introduces a resolution’s effective text in a document.
