Donatio mortis causa – From Latin: The term refers to a death-bed gift, made by a dying person, with the intention that the beneficiary of the gift shall keep the thing if death ensues. Such a gift is exempted from the estate of the deceased as property is automatically conveyed upon death. In most jurisdictions, real estate cannot be transferred by these death-bed gifts. The Real Estate Law in some jurisdictions provises that every person is free to manage their own assets during their life, as long as they do it in the proper legal form and can consider their own actions.
