Illegal detention

Illegal detention – this legal term finds application in the Criminal Law. There it details illegal imprisonment or arresting – i.e. unlawful taking in custody. This usually occurs in situations where there are no enough evidences for the guilt of the captured or sentenced person. Or in cases where the wrong person has been arrested by mistake. The illegal detention is tort in some countries and a crime in another, but always a legal base for suing the responsible authorities for compensation. Sometimes known as “unlawful detention” or “false imprisonment”. The term is different than “unlawful detailer”, which in the Property Law refers to keeping a property of somebody else, where the possessor had former rights on it.
