Judgment in default – per the meaning of the Civil Law in many jurisdictions this is a judgment obtained on the base of the failure of the defendant to respond to the civil claim and to appear on the appointed court hearing for the performance of which he has been notified about. The court decision in favor of the claimant, obtained during judgment in default, can not be appealed later by the defendant, respectively enters in force immediately. Also called in some jurisdictions “judgment in liability”.
