Maintenance contract – this legal term is mostly used in the Property law, where the assignor (the owner) or a group of assignors within a complex, on the base of a taken decision by the General Meeting, hires a maintenance company to perform the maintenance services within the common parts of the building/complex. This contract is advisable to be prepared by an independent property lawyer in order to secure the rights of the parties, due to the fact that in some legal systems, it is possible for the maintenance company to prefer the contract to be registered at the Land Register as a legal burden on the apartment, for its term. And it is understandable that no legal burdens are convenient for the apartment owner.
