Bad Title

Bad Title – this term is used mainly in the Real Estate Law. In many jurisdictions, the bad title will occur, where the ownership can not be transferred free of burdens towards the beneficiary. I.e. the beneficiary of title will receive the bundle of rights, but there will be issues related either to debts secured with the property, or taxes for the property due towards the Authorities, or third parties’ rights, registered on the file of this property. Basically the bad title is not a clear, pure ownership, but a defective one.
