Quod permittat prosternere – this term comes from Latin and means “giving leave to demolish”. It is used in the area of Court Proceedings, where refers to an order issued by the court and directed to the defendant. It orders him to allow the claimant to abate the nuisance, or to prove why he shouldn’t be allowed to do so. In situation where the claimant proves the stated by him facts and circumstances, then he should be entitled to have judgment to abate the nuisance and to recover damages.
