Prevailing party – this term is used in the area of Court Trials. It refers to the figure of the party, which is winning the case – i.e. in which favor the court will decide with a valid and binding decision. The prevailing party has presented stronger and non-disputable proofs at court in order to prove their legal point, so this party will obtain judgment in his/her own favor.
