Capias ad audiendum judicium

Capias ad audiendum judicium – this legal phrase comes from Latin. In the legal practice, it has got application in the area of Criminal proceedings. There it details a writ, issued by the court, and asking the accused to be brought before court to hear the judgment against them, since they haven’t appeared on the previous hearings. Usually the role of capias ad audiendum juricium is to ensure that the accused will be informed about the court decision and for the possibilities for appeal, and respectively if it is jail punishment, to secure immediate execution (if there is impossibility for appeal). The origin of the term is the word “capias”, which literally means “court order, a writ”.
