Hypothecate – the term refers to a situation where to establish a burden on a real estate as a security for a loan, where the property is still in possession of the debtor. Registration of the legal burden, for example, a mortgage, at the Land Registry Agency, entitles the establisher to be first privileged creditor in case of execution procedure.
